McIntyre waives arraignment

Justin B. McIntyre, 23, will go straight to trial on the first-degree child abuse charge. A final pre-trial conference is scheduled for Nov. 26, and a jury trial has been set for Dec. 18 at 9 a.m. McInytre has been in jail since Aug. 24 after he allegedly shook the Bentley McIntyre – then six weeks old – in the Ferrysburg home where he was staying with his girlfriend and other family members. His girlfriend and the child's mother, 19-year-old Kaylee Zalsman, was at work at the time.

Born on July 20, Bentley was in serious condition at Helen DeVos Children’s Hospital in Grand Rapids before recovering enough to go home on Sept. 19.

Zalsman said Bentley passed smiling and cooing milestones while at the hospital. Doctors won’t know the extent of the brain damage until he fails a certain milestone for his age.

In the meantime, Bentley is on seizure medication as he continues his recovery.
