The parents filed suit Monday against Hope Academy of West Michigan and the Grand Rapids Police Department. The suit says police wrongly treated it as a runaway case.

Grand Rapids city attorney Catherine Mish said the claims in the "frivolous lawsuit" have "no legal basis."

The lawsuit says the girl was 14 at the time, but Mish said a police report indicates she was 16.

A message was left Tuesday with Hope Academy.

The suit says after being told she was suspended and to leave, the student was approached by a man who later raped her in his home. It says she was gang-raped at two other places as well.
