Emory’s attorney, Terry Jones, asked Muskegon County Circuit Judge William Marietti for sympathy. Jones pointed out Emory’s otherwise clean criminal history.
Muskegon County Senior Assistant Prosecutor Randy Kostrzewa asked the judge for strict probation terms, arguing that Emory’s actions were calculated and criminal.
“He lied his way into a first-grade classroom and used every one of those children,” Kostrzewa said.
Emory did not offer any apologies in court to the parents of the children who appeared in the video.
Peter Berns, Emory’s uncle, said the pending jail sentence his nephew has faced for weeks has taken a toll on Evan and his family.
“He knows he made a mistake,” Berns said.
