Lawyer: Man to be wrongly sentenced in officer's death

Kim Statler will be sentenced Monday in federal court for being a felon in possession of guns. There’s no dispute that it was Statler’s brother who shot Officer Eric Zapata last April, but Statler was at the scene, and prosecutors are calling for at least 41 months in prison.

In a court filing, defense attorney Keith Turpel said there’s “sentiment to make someone pay” for the officer’s death. He said Statler would face a lower penalty in state court.

Statler’s brother Leonard killed himself during the shootout with Kalamazoo police. Authorities said guns under Kim Statler’s control were used in Zapata’s death.
